Data Management Regulation
1. Person of Data Controller
The personal data of the data subjects are processed by Adecco Kft. (Seat: Váci út 45. G. ép. 7., 1134 Budapest, Hungary; Company registration no: 01-09-071602; Tax no.: 10443314-2-44; hereinafter: "Adecco").
The Adecco processes the personal data presented by the data subjects on the homepage www.adecco.hu as well as other particulars transferred in another way by such persons.
The Adecco is a business company duly registered in accordance with Hungarian legal rules.
2. Data subject(s)
Data subjects are all those who visit the website www.adecco.hu and make use of the services offered. Data subjects are those, too, who make use of the services provided by the Adecco, endeavors to do so by answering the invitation published by the Adecco, signs a contract with the Adecco, forwards or conveys his/her particulars to the Adecco, and signs in to the Adecco's system.
3. Effect and modification of the regulation
The effect of this Data Management Regulation (hereinafter: "Regulation") covers the data management of the Adecco.
Unless otherwise stipulated the effect of the Regulation does not cover data management made by third parties - particularly by advertisers, potential employees, and intermediate persons taking part in the selection.
The Adecco reserves the right of modification of the Regulation. Upon request the Adecco is ready to inform data subjects about former modifications. The Adecco shall publish the modified Regulation; the modifications enter into force only after their publication.
4. The activity of the Adecco
The Adecco provides labor market services to both employers and employees. The activity of the Adecco primarily consists of labor force mediation, lending of the same, organization, outsourcing of HR services and consultation. The Adecco processes personal data primarily in connection with such services.
5. Normative legislation
The Adecco is a business company duly registered in Hungary, who carries out its activity first of all under the effect of the Hungarian legislation. Should the activity of the Adecco cover an area beyond the Hungarian border, the legislation of the target country is normative with the condition that in case any of these legislations can be stipulated, the application of the Hungarian one will be stipulated.
In case there is an option of stipulating the jurisdiction, the Adecco will stipulate the jurisdiction of the Hungarian authorities and courts.
As far as data processing is concerned the Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information as well as the Act I of 2013 on the Labor Code shall apply.
6. Main characteristics, legal ground and principles of data processing
Personal data will be processed by the Adecco.
The legal ground of data processing is the voluntary consent of the data subjects and - in case of the processing of certain particulars - the provision of the law.
Simultaneously with the registration of data the Adecco informs the data subject about the fact that this Regulation shall apply for the processing of his/her data; apart from that the Adecco shall make available this Regulation any time to the data subjects. When supplying information and data the data subjects accept this Regulation - regardless of the method of data supply. The acceptance of this Regulation is considered as a statement of consent to data processing.
This Regulation if qualified as information of the data subject.
In case the data subject enters a legal relationship with the Adecco also the normative legal rules for data processing become authoritative. The legal ground of data processing ordered by the legal rule or made available by a legal rule is the provision of the relevant legal rule.
In case the particular data processing occurs on the basis of the consent of the data subject, the Adecco will have the right to process such data even without the consent of the data subject and even after withdrawal of the consent of the data subject with the purpose of the fulfillment of the legal obligation regarding the Adecco or with the purpose of the enforcement of the rightful interest of the Adecco or that of the relevant third party (if the enforcement of this interest is in proportion with the limitation of the right of personal data protection).
The Adecco aims at the enforcement to a maximum extent of the following data processing principles for particulars:
- the processing of personal data occurs only for a well determined purpose;
- the data processing corresponds to this purpose in every phase including the scope of the processed particulars;
- the registration and processing of personal data is always faithful and legal;
- the data are exact, entire and update;
- in case the data subject is not necessarily to be identified, the data processing will be modified in a way that the data subject should not be identified on the basis of such data;
- the rights of the data subject shall prevail.
7. Place of data processing
The particular data will be processed on the seat, branch, headquarters of the Adecco or in the premises of data processing of the agent (technical data processor) of the Adecco. Decisions regarding data processing will be passed by the Adecco.
8. Purpose of data processing
The objective of personal data processing is the provision and development of the services of the Adecco. The Adecco processes the data of the data subjects first of all with the following objectives:
a. Identification of the data subjects, maintenance of contacts with them;
b. Revelation of the degree, preparedness and demands of the data subject - characteristics that are important from the point of view of the appropriate employment;
c. Search for and finding an appropriate employment and scope of work for the data subject - in consideration of his/her degree, preparedness and demands;
d. Creation of a contact between the data subject and his/her potential employer;
e. Seconding the establishment and the maintenance of the employment;
f. Follow-up and support of the professional development of the data subject;
g. Establishment and maintenance of an employment aiming at lending between the data subject and the Adecco;
h. Fulfillment of the legal obligations burdening the Adecco (e.g. declaration, data supply);
i. If the data subject is not suitable for the job applied for but his/her data are processed by the Adecco the purpose of data processing remains the offer of a job later on.
A further objective of data processing is the practice of rights and the fulfillment of obligations originating from the legal relationship eventually established between the Adecco and the data subject.
The aim of processing the registered data: analysis, drawing up statistics.
9. Scope of the processed data
The Adecco processes following personal data of the data subject:
- Personal identification data of the data subject (name, place and date of birth, nationality, home address, sex, family status);
- Personal identification codes, numbers of the data subject (tax identification sign, TAJ number);
- Data necessary for the maintenance of contracts (home address, postal address, phone number, e-mail address);
- Data regarding school degree, other qualification and command of languages of the data subject;
- Data of the former employment, jobs, professional career of the data subject;
- Data of the employment and scope of activity, the preparedness and aptness of the data subject (including possible employment and jobs);
- Data relating to the performance of work;
- Other data specified in the CV or in other documents by the data subject;
- Data relating to the different legal obligations (tax return, declarations, data supply).
In case of visiting the website www.adecco.hu the IT system of the Adecco registers automatically the IP address of the computer of the data subject, the date of beginning of the visit and in certain cases - depending on the adjustment of the computer - the type of the browser and the operation system as well as the geographical place to be specified on the basis of the IP address. The data processed this way cannot be connected to other personal data. The data processing serves solely for statistical purposes.
The Adecco reserves the right to insert a data file (cookie) on the machine of the data subject.
10. Registration of data
The Adecco processes data originating from the sources below:
- Personal data given by the data subject;
- Personal data disclosed by the data subject;
- Data forwarded by the data subject to third party if the conveyance of data is consented to by the data subject.
On the basis of the above the registration of data can occur as follows:
- By advertisement published by the Adecco (online or offline): the Adecco advertises at several portals, in newspapers, at job fairs and the data subjects give their personal data by answering the ads.
- By means of recommendation: if a third party forwards the data of the data subject (e.g. CV), data are processed by the Adecco, and it informs the data subject accordingly (in case the data subject protests, the Adecco cancels the relevant data).
- Direct registration: the data subject can sign in on the website www.adecco.hu.
- "Head-hunting": the Adecco takes over data from registers, to which the data subject forwarded his/her data expressly for job-searching, in knowledge of eventual re-forwarding of the same.
- Personal data input: the data subject has the option to supply his/her data in person in the premises of the Adecco.
- Voluntary data supply of the data subject: if the data subject supplies his/her data voluntarily, without formal demand to the Adecco in the course of searching a job, the Adecco will process such data.
- Interviews: the Adecco processes the data registered in the course of the interview with the data subject(s).
Over and above these procedures the Adecco will process the personal data to be supplied by the data subject later on as well as the data, which arise in the framework of the connection established between the Adecco and the data subject (e.g. data relating to the performance of work by the latter.).
11. Storing of data
The Adecco will store the data registered in an electronic way in its IT system. In the course of that certain data written on paper will be introduced and processed in the computer (e.g. identification data, data regarding the skills and qualification). The data written on paper are stored by Adecco with respect to the rules of file management.
In case the affected candidate is not suitable for a given job, the Adecco will inform him/her accordingly. The data will be stored even in this case in order to be able to submit him/her an offer later on if the possibility occurs. If required by the data subject the Adecco erases the stored data.
12. Access to the processed data, data transfer, use of the data
Only persons acting on behalf of the Adecco - particularly agents, employees - have access to the data, who actually need such access for the performance of their work and who are aware of their commitment in regard to data processing.
The Adecco forwards or makes available the processed data to third parties only in the case if expressly consented to by the data subject or if ordered by the law.
If the data subject applied for a certain job and he/she meets the relevant requirements, the relevant data are forwarded by the Adecco to the employer unless the data subject forbids it in knowledge of the employer.
The Adecco has the right to use the data for statistical purposes in a way improper for personal identification.
13. Use of data processor
In conformity with the relevant legal rules the Adecco is entitled to employ a data processor for the purpose of certain technical operations. The data processor is only entitled to carry out the decisions of the Adecco in accordance with the instructions of the latter. The use of the data processor does not affect the responsibility of the Adecco.
For the purpose of archiving the data the Adecco employs - as data processor - the Rhenus Office System Hungary Kft. (seat: Leshegy u. 30., 2310 Szigetszentmiklós, Hungary). The data processor performs the tasks relating to the preservation and storing of certain documents on paper-base.
For information technology service providing the Adecco employs - as data processor - the business company named Capgemini Espana S.L. (seat: Anabel Segura 14, Alcobendas, Madrid, Spain). The data processor performs the tasks relating to the provision of IT services and to the technique of data storing.
14. Data safety
The Adecco takes all the measures that can be expected from it for the safety of the stored data, it provides for their guarding at an appropriate level with particular regard to unauthorized access, alteration, forwarding, disclosing, cancellation of destruction as well as to accidental destruction and damaging.
The Adecco provides for appropriate technical and organizational measures in order to maintain safety of the stored data.
15. Duration of data processing, erasure of data
The data subject can ask - except data processing based on legal rules - for the erasure of his/her personal data. In case of such a demand by the data subject the Adecco will erase the relevant data within five working days. If data processing occurred on the basis of the consent of the data subject, the Adecco will have the right to process such data even after withdrawal of the consent of the data subject in order to fulfill legal obligations in regard to the Adecco or in the interest of the enforcement of the legal interest of the Adecco or of a third party (if the enforcement of such interest is in proportion with the limitation of the right concerning the protection of personal data).
The Adecco will erase the personal data - except data processing based on legal rules - if three years passed since registration. In certain cases the Adecco contacts the data subject - if the possibility of later mediation of the relevant job arises - prior to erasure and if the data subject agrees, it continues processing the relevant data. The duration of three years of data processing is motivated by the fact that within this time the data subject has a real chance of finding an appropriate job.
The Adecco erases the data – with the exception of the obligatory data processing – if the target of data processing ceases particularly if the Adecco cannot offer any appropriate job for the data subject and any future chance is improbable.
In case of the obligatory data processing (on the basis of legal rules) the Adecco will process the data for the duration as specified by the legal rules.
Should a civil legal relationship arise between the data subject and the Adecco the rules of civil law shall apply for the data processing. In this case the personal data can be processed with the purpose of enforcement of civil claims. If, for the reason of an illegal action by the data subject proceedings by the authority or the court are initiated against him/her, the Adecco is entitled to process the relevant data in the interest of the successful closing of the proceedings.
On the basis of the above the Adecco is free to delete the data in question if
- the processing of the same is illegal or a legal rule orders the cancellation;
- required by the data subject;
- the data are incomplete or erroneous that makes the use impracticable,
- the purpose of data processing ceases,
- ordered by an authority or the court.
In the course of the erasure of personal data the data will be rendered unrecognizable so that the relationship between data and the data subject cannot be restored anymore.
16. Rights of the data subjects
The data subject has the right to correct his/her data or to ask for the correction of the data not correctible by him/her from the Adecco. The data subject has the right to ask for the erasure of his/her data as per paragraph 15. The data subject can ask for information about data processing, and the Adecco shall forward such information within 30 days in a comprehensive form. The data subject can ask for to information to be put in writing.
17. Responsibility of the data subject
The data subject can register only his/her own personal data. The disclosure of the data of other persons – unless consented to – is qualified as illegal data processing consequently it implies consequences as specified by separate legal rules. In case of misuse of personal data of other persons the Adecco shall give assistance to the competent authorities in order to reveal infringement and to identify the offender.
18. Rules regarding borrowed employees
As to the data processing of employees in relationship with the Adecco as a business company dealing with lending of labor force the provisions of the Labor Code and other legal rules on employment shall apply. The Adecco is not responsible for data processing at the borrowing party.
The Adecco will process all personal data relating to the performance of work and the work quality of the data subject.
19. Data protection register
The Adecco has duly reported its data processing activity to the registrar of the National Authority for Data Protection and Freedom of Information. Identification number of the register file: NAIH-65636/2013.
20. Enforcement of right
Complaints of objections by the data subjects can be submitted directly to the Adecco. The Adecco will do its utmost in order to remedy eventual legal offences of injuries. The Adecco will check complaints received and inform the data subject about its standpoint and the measures taken.
The data subject is free – on the basis if the Act CXII of 2011 on information right to self-determination and the liberty of information – to turn to the National Authority for Data Protection and Freedom of Information (www.naih.hu) or enforce his/her rights by means of the Court.
